Abstract

Although it is generally assumed that Spanish property forms clearly dominated the concepts of property and pre-Hispanic jurisdiction, current indications point to a complex and long-term process in which Indian lands and other rights continue to be discussed. This paper aims to contribute to the discussion about the factors that allowed some Indian peoples to retain their lands during the colonial period.
